Reimager – Disclaimer and End User License Agreement (EULA)

Effective Date: September 12, 2025

Developer: Xcitation Software


1. Acceptance of Terms

By downloading, installing, or using Reimager (“the App”), you agree to be bound by this End User License Agreement (“Agreement”). If you do not agree, do not install or use the App.


2. License Grant

The Developer grants you a personal, non-exclusive, non-transferable, revocable license to use Reimager for personal or business image processing. You may not distribute, resell, reverse-engineer, or modify the App except as expressly permitted by applicable law.


3. User Responsibilities

  • Backups: You are solely responsible for maintaining complete backups of your images and data before using the App.

  • Safe Usage: You agree to practice with non-critical test files before using the App on important images.

  • Archiving: You agree to use the App only with files that are properly backed up and archived.

  • Compliance: You are responsible for ensuring your use complies with all applicable laws.


4. Risks of Use

Reimager is designed to process and convert image files. However, no software is error-free. Using the App may result in data loss, corruption, or other unintended outcomes. You understand and accept these risks.


5. Disclaimer of Warranties

The App is provided “as is” and “as available”, without warranties of any kind, express or implied. The Developer disclaims all warranties, including but not limited to fitness for a particular purpose, non-infringement, and performance.


6. Limitation of Liability

To the maximum extent permitted by law:

  • The Developer shall not be liable for any damages, including but not limited to data loss, corruption, loss of profits, or consequential damages, arising out of or related to your use of the App.

  • Your sole and exclusive remedy for dissatisfaction with the App is to stop using it.


7. Updates

The Developer may provide updates, bug fixes, or enhancements at its discretion. Continued use of the App after updates constitutes acceptance of this Agreement as updated.


8. Termination

This license is effective until terminated. It will terminate automatically if you fail to comply with this Agreement. Upon termination, you must stop using and uninstall the App.


9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of California/United States. Any disputes shall be resolved in the courts of the California/United States.

SPO₂er – Disclaimer (Not Medical Advice)

1. Informational-Only, Not a Medical Device

SPO₂er is a convenience and visualization tool that reads Blood Oxygen (SPO₂) data from Apple’s Health app (HealthKit) and displays it on your iPhone and Apple Watch (including as complications and simple graphs). SPO₂er is not a medical device, is not cleared or approved by any regulatory authority, and is provided for informational purposes only.

SPO₂er does not provide medical advice, diagnosis, treatment, or recommendations. You should always consult a qualified healthcare professional regarding any questions or concerns about your health or your Blood Oxygen levels.


2. No Clinical Use or Emergency Use

SPO₂er is not intended for:

  • Monitoring critical medical conditions.

  • Making clinical decisions or adjusting medications.

  • Detecting or managing emergencies.

If you feel unwell, short of breath, dizzy, or otherwise have any health concern, do not rely on SPO₂er. Seek medical attention or contact emergency services as appropriate in your region.


3. Data Source and Accuracy

SPO₂er does not measure Blood Oxygen directly. Instead, it reads SPO₂ samples from:

  • Apple’s Health app (HealthKit) on your iPhone; and

  • Any compatible Apple Watch or third-party devices and apps that write Blood Oxygen data into HealthKit.

Because SPO₂er depends entirely on the data in HealthKit, it cannot guarantee the availability, timing, completeness, or accuracy of that data. Variations can occur due to device hardware, watch fit, movement, lighting, skin perfusion, sensor limitations, or third-party device behavior.

You are responsible for verifying important values directly in the Health app if accuracy matters to you. SPO₂er is only a view of data managed by Apple’s Health platform and participating devices.


4. No Guarantee of Continuous Monitoring

Apple Watch and third-party devices may take SPO₂ readings at irregular intervals, and measurements may not occur during sleep, certain activities, or specific wrist positions. SPO₂er does not provide continuous monitoring or guaranteed sampling frequency.

Even if a watch face or complication appears up to date, it may not reflect your current physiological state and should not be relied upon for real-time health decisions.


5. Not a Substitute for Professional Care

Nothing in SPO₂er should be interpreted as medical, nursing, or professional health advice. You must not ignore or delay seeking professional medical advice because of SPO₂er’s display of historical or recent SPO₂ values.

If your healthcare provider has given you guidance regarding Blood Oxygen levels, that guidance always takes precedence over what you see in SPO₂er.


SPO₂er – End User License Agreement (EULA)

1. Acceptance of Terms

By downloading, installing, or using SPO₂er (the “App”), you agree to be bound by this End User License Agreement (“Agreement”), in addition to Apple’s Standard End User License Agreement where applicable. If you do not agree, do not install or use the App.


2. License Grant

The Developer grants you a personal, non-exclusive, non-transferable, revocable license to install and use SPO₂er on your compatible devices solely to view and visualize Blood Oxygen data that exists in the Apple Health app. You may not distribute, resell, reverse-engineer, or modify the App except as expressly permitted by applicable law.


3. Use of Health Data

  • HealthKit access: SPO₂er uses Apple’s HealthKit framework to read Blood Oxygen (SPO₂) data that you have chosen to store in the Health app and to which you explicitly grant permission.

  • No cloud collection: SPO₂er does not transmit your health data to Xcitation Software’s servers. All processing is intended to occur on your devices.

  • Your control: You can change or revoke Health permissions at any time in the Health app or system settings. If you do so, certain SPO₂er features may stop working.


4. User Responsibilities

  • Health decisions: You agree not to rely on SPO₂er for medical decisions, diagnosis, or treatment.

  • Verification: You are responsible for confirming any important health information directly in the Health app or with your healthcare provider.

  • Compliance: You are responsible for ensuring your use of the App complies with all applicable laws, rules, and guidelines, including any restrictions on handling health data in your jurisdiction.


5. Disclaimer of Warranties

SPO₂er is provided “as is” and “as available”, without warranties of any kind, express or implied. Without limiting the generality of the foregoing, the Developer does not warrant that:

  • The App will always display timely, accurate, or complete Blood Oxygen data.

  • The App will operate uninterrupted or free from errors or bugs.

  • Any visualizations, averages, or graphs are clinically meaningful or suitable for medical interpretation.

All implied warranties, including but not limited to fitness for a particular purpose and non-infringement, are disclaimed to the fullest extent permitted by law.


6. Limitation of Liability

To the maximum extent permitted by law:

  • The Developer shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including, without limitation, loss of data, health consequences, or loss of profits) arising out of or in connection with your use of the App.

  • You understand that any interpretation or action you take based on SPO₂er’s displays is solely at your own risk.

  • Your sole and exclusive remedy for dissatisfaction with the App is to stop using and uninstall it.


7. No Emergency or Life-Support Use

You agree not to use SPO₂er for any life-support, emergency response, or real-time critical monitoring scenarios. The App is not designed or intended for such purposes and must not be used where its failure or inaccuracy could result in injury or death.


8. Updates

The Developer may provide updates, bug fixes, or enhancements to SPO₂er at its discretion. Continued use of the App after such updates constitutes acceptance of this Agreement as updated.


9. Termination

This license is effective until terminated. It will terminate automatically if you fail to comply with this Agreement. Upon termination, you must stop using and uninstall SPO₂er from your devices.


10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of California/United States. Any disputes shall be resolved in the courts of the California/United States.
